OJAR Privacy Policy

We at OJAR respect your privacy and value the relationship we have with you. Your visit to this website is subject to this Privacy Policy and Terms and Conditions. This Privacy Policy describes the types of personal information we collect on the OJAR website, currently located at www.ojarofficial.uk (this “Site”), how we may use that information and with whom we may share it. Our Privacy Policy also describes the measures we take to protect the security of this information as well as how you can access, modify or delete your personal information. It also explains how you can object to the processing of your personal information or to receiving communications about our products and services.

Please note that this Privacy Policy governs only information provided to OJAR. It does not govern any other information or communications that may reference OJAR, e.g., communications from OJAR counters located within brick and mortar retail stores. Information We Collect and How We Use It

For the purposes described in this Policy, OJAR may collect the following categories of personal information:

1. a) Identification and Contact information (such as name, address, phone number or e-mail address), when you are willing to provide them for instance to sign up for an online account or fill out a customer information card in store, to participate in an event, to make a purchase, or ID information necessary when you request a VAT-refund or a “click and collect” service in store .
2. b) Payment information: for instance credit card details, bank account numbers, paypal account details or other payment details which you must provide to receive products or services you have ordered from us
3. c) Demographic information like your gender and birthday.
4. d) Preferences and interests which you choose to disclose in the course of your privileged contacts or encounters with our client advisors (which may include your preferences about our collections or other luxury brands, your size, your lifestyle, or basic information on your family circle)
5. e) information, which may include health information, related to possible adverse effect caused by our cosmetic products
6. f) Information you submit or post in a public space, on our social media pages or our websites, for example for a product review.
7. g) Information about your purchases online or in stores. This could include the products you purchased and their prices.
8. h) If you use our web sites, we may collect information about the browser you are using, and your browsing behaviour.
9. i) If you use our mobile app, we may collect your GPS location, subject to your consent when required. We might also look how often you use the app and where you downloaded it. We may collect information about the browser you are using, and your browsing behaviour.

If you choose not to submit any personal information when requested to perform a contract or when required by law, you will not be able to receive the product or service you ordered or otherwise register on our web sites, apps or other media.  

Use of Personal Information by OJAR

1. Marketing Communications If you so elect, the information you provide may be used by OJAR to create and deliver to you communications such as our newsletters, surveys or other messages containing product and event information, cosmetics tips or promotions ("Communications"). If you prefer not to receive such Communications, please do not elect to receive them. If you do so elect and later decide that you would no longer like to receive these Communications, see "Your Choices" Section below.
2. Text Messages: If you so elect, you may provide your mobile phone number in order to receive text message alerts containing product and event information, cosmetics tips or promotions (“Text Messages”). There is no fee from OJAR to receive Text Messages, however, your mobile service provider may charge you for sending and/or receiving text messages and air-time, as well as any other standard applicable rates charged by your mobile service provider and OJAR shall not be responsible or liable for any fees charged by your mobile service provider or any other costs howsoever incurred by you for receiving Text Messages. If you do elect to receive them and later decide that you would no longer like to receive these Text Messages, see the “Your Choices” Section below.
3. Communications to Serve: You If you have elected to provide us with your contact information, we may provide you with service related announcements by any means, including email, concerning the Site or contact you regarding your customer service requests or questions. These types of communications are necessary to serve you, respond to your concerns and to provide the high level of customer service that OJAR offers its customers.
4. Customized Service: We may use your personal information to provide you with customized service and use of our Site. For example, we may suggest products that would be of particular interest to you. 
5. Special Events, Questionnaires and Surveys: On occasion, OJAR may sponsor special events (such as contests, sweepstakes or other offerings), questionnaires and surveys. We strongly suggest you review any applicable rules before participating. To the extent any special event, questionnaire or survey is not subject to specific rules, the processing of personal information is governed by this Privacy Policy and the purposes it sets forth.

We will retain your information for further recruitment opportunities that may arise, unless you tell us that you no longer wish for us to retain your information.

Why we collect this information

We collect this information so we can personalize your shopping experience and make sure you can easily find what you really want and need. We also use it to process your orders efficiently and accurately (i.e. we might have to call you to confirm an address), for statistical and survey purposes, to make sure you’re included when we consider making site changes and/or adding new product lines and ensure the web content advertisements appearing on your screen are specially tailored to your needs. 1. OJAR. We may share your personal information with our Affiliates that distribute and market OJAR products. OJAR Companies may use this information in accordance with this Privacy Policy including, if you have so elected, to send you Email containing product information, cosmetic tips or promotions. If you prefer that we not share your personal information with OJAR Companies, please do not provide it to us. We are unable to offer the benefits of OJAR to anyone who does not consent to the sharing of their personal information with OJAR Companies.
2. Third Parties. We may retain other companies and individuals to perform functions on our behalf consistent with this Privacy Policy. Examples include data analysis firms, customer support specialists, email vendors, webhosting companies and fulfillment companies (e.g., companies that coordinate mailings). Such third parties may be provided with access to personal information needed to perform their functions but may not use such information other than on our behalf and in accordance with this Privacy Policy.

In addition, in some instances, you may be offered the opportunity to consent to the sharing of your information with a third party such as an event or promotion co-sponsor. All Affiliates, OJAR Companies and third parties that receive your personal information are required to honor the privacy representations made in this Privacy Policy, regardless of where they are located.

Information We collect about you may be transferred to, stored and processed in countries / regions where an OJAR entity is located to ensure you may benefit from better services wherever you visit us and for the purposes defined in this Policy.

We may also transfer your personal information to the service providers involved in the maintenance of our web sites, apps or social media or any other tool used for the processing of our clients or prospects information.

Some recipients are located in third countries / regions which are considered as not providing the same level of data protection as the EU country in which you provided your information.

Children’s Privacy

If you are under 18 years of age, you may browse our Site. However, you may not provide personal information to us. For example, you cannot register. This Site is not designed for persons under the age of 18 and we do not knowingly collect personal information from anyone under the age of 18. OJAR will take reasonable steps to inform the other entities of the OJAR group of such erasure.

You can request the restriction of the processing (i) in the event the accuracy of your personal information is contested to allow OJAR to check such accuracy, (ii) if you wish to restrict your personal information rather than deleting it despite the fact that the processing is unlawful, (iii) if you wish OJAR to keep your personal information because you need it for your defence in the context of legal claims (iv) if you have objected to the processing but OJAR conducts verification to check whether it has legitimate grounds for such processing which may override your own rights.

You also have the right to lodge a complaint with the competent supervisory authority.

The trademarks, logos, service marks, industrial drawings and any other signs, designations or symbols which may be used for industrial or commercial purposes and which are displayed on the Site (collectively, the “Trademarks”) are the registered and unregistered marks of OJAR, our Affiliates, our licensors or our partners, in the United Arab Emirates and other countries, and are protected by trademark and industrial property laws.

Except as set forth in the limited license in Limited Licenses section below, the Site (in whole or in part), the Content and the Trademarks may not be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent.

Submissions

It is our policy to decline unsolicited suggestions and ideas. You may not use a false email address, impersonate any person or entity, or otherwise mislead us as to the origin of any Submission. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold us harmless for any loss, damages or costs, including attorneys' fees, resulting from any third party claim, action, or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damages, or costs, including attorneys' fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

Disputes

With respect to any dispute regarding the Site, your rights and obligations and all actions contemplated by these Terms and Conditions shall be governed by the laws of the United Arab Emirates, as if the Terms and Conditions were a contract wholly entered into and wholly performed within UAE, subject to foreign legal mandatory provisions. To the fullest extent permitted by applicable law, any dispute relating in any way to your visit to the Site shall be submitted to confidential arbitration in Dubai, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any court, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the International Chamber of Commerce. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. 

To the extent arbitration is not permitted by applicable law, any dispute relating in any way to your visit to the Site shall be submitted to an appropriate court or other judicial body in Dubai, as applicable, without prejudice to the applicable law and all applicable provisions of this section, and subject to our right to seek injunctive or other appropriate relief in any court, if you have in any manner violated or threatened to violate our intellectual property rights and you consent to exclusive jurisdiction and venue in such courts.

General

You acknowledge and agree that these Terms and Conditions constitute the complete and exclusive agreement between us concerning your use of the Site, and supersede and govern all prior proposals, agreements, or other communications. We reserve the right, in our sole discretion, to change these Terms and Conditions at any time by announcing and posting the changes on the Site. Any changes are effective immediately upon posting to the Site and your continued use of the Site constitutes your agreement to all such modified Terms and Conditions. We may, with or without prior notice, terminate any of the rights granted by these Terms and Conditions, to the fullest extent permitted by applicable law. You shall comply immediately with all termination or other notice, including especially, as applicable, by ceasing all use of the Site.
